Vermont Surrogacy Laws

YOU CHOOSE THE DONOR, WE DO THE REST.

Surrogacy is a family planning avenue that offers intended parents the unique opportunity to have a biological link to the child the surrogate will carry for them. If you have decided that surrogacy is the right path for your family planning goals, you are now one step closer to realizing your dreams of parenthood. To ensure that the surrogacy journey goes as smoothly as possible, it is important to have in-depth knowledge of the surrogacy laws in place in the state of Vermont.

At Elevate Baby, our Vermont surrogacy agency will ensure that intended parents have knowledge of the surrogacy laws that may affect their journey to ensure they can feel confident taking the next step. We want your experience as an intended parent to be as exciting and joyful as possible, and we will go above and beyond to make sure we can help in any way we can.

What Are the Eligibility Requirements for Surrogates in Vermont?

The job of a surrogate mother is an incredibly important one. After all, the women who become surrogates in Vermont are bringing life into the world and helping intended parents build the families they have always dreamed of. With that being said, not just anyone can become a surrogate.

Surrogate mothers must meet certain requirements to be eligible to take on the job of carrying children for intended parents. These requirements may differ from state to state, in addition to our own agency requirements. The eligibility requirements for surrogates in Vermont are as follows:

  • Surrogate mothers must be between the ages of 21 and 40 years old
  • Surrogates should have a body mass index of 32 or lower
  • Surrogate mothers should already have given birth
  • Surrogate mothers should already be raising at least one healthy child
  • Surrogate mothers should be healthy
  • Surrogate mothers should be non-smokers
  • Surrogate mothers should be financially stable
  • Surrogate mothers must be willing to undergo medical and psychological evaluations

At Elevate Baby, we believe that the surrogacy journey should be as stress-free as possible. This helps our team ensure that all of the surrogate mothers we work with meet each of the requirements for surrogacy eligibility for the state and our own agency criteria. This is important not only for legal purposes, but also to ensure that the surrogacy journey has the best chance of being successful.

What Types of Surrogacy Are Legal in Vermont?

In Vermont, there are no laws that either allow or prohibit different types of surrogacy. Because of this, both types of surrogacy are technically legal in the state. The two types of surrogacy are traditional and gestational surrogacy.

Traditional Surrogacy

This type of surrogacy is when the surrogate mother has a genetic link to the child that they carry for the intended parents. However, in Vermont, this type of surrogacy is treated as an adoption. This means that a surrogate may not be able to receive base compensation and may be subject to strict regulations regarding the termination of her parental rights after the birth of the child. Elevate Baby does not offer traditional surrogacy services.

Gestational Surrogacy

Gestational surrogacy is when the surrogate, or gestational carrier, has no genetic link to the child they carry for intended parents. Elevate Baby only offers gestational surrogacy services.

What Must Be Covered In a Vermont Surrogacy Contract?

A surrogacy contract is similar to any other contract that aims to protect both parties entering into a legal relationship. Our surrogacy agency and the reproductive attorneys we work with have created a process for the proper drafting of a surrogacy contract that protects the rights and interests of all parties involved to ensure that there are no hiccups throughout the journey.

In Vermont, intended parents and surrogates must be represented by separate reproductive attorneys during these legal aspects. These attorneys will negotiate a document that addresses all important aspects of the surrogacy journey, including the following points:

  • The amount of compensation that the intended parent(s) will pay to the surrogate mother
  • The medical and living expenses the intended parent(s) will take care of for the surrogate
  • Whether the surrogate will be able to choose a local provider for her care
  • That the donors, if they are not the intended parents, will give up all parental rights to the child
  • That the intended parent(s) will become the child’s legal parents upon the birth of the child
  • The risks of liabilities for all parties involved in the journey
  • Agreed upon terms and conditions regarding termination and selective reduction

Our team of surrogacy agents can assist you in perfecting your surrogate agreement before you or any other involved parties sign. To begin your surrogacy journey with Elevate Baby, contact our Vermont team today.
