Alabama Surrogacy Laws

YOU CHOOSE THE DONOR, WE DO THE REST.

Because surrogacy is a unique family planning avenue that offers intended parents the opportunity to have a biological link to the child the surrogate will carry for them, it is no surprise that so many intended parents are ready to jump right into the journey and get matched with one of our elite surrogate mothers. However, it is important to have in-depth knowledge of the surrogacy laws in place in the state of Alabama before intended parents are matched with a qualified surrogate in order to ensure that the journey goes smoothly.

At Elevate Baby, we work hard to be able to ensure that the intended parents and surrogates we work with have knowledge of the surrogacy laws that may affect their journey. This is an important step of preparing for the surrogacy journey, as it allows everyone involved to feel confident taking the next step. We want everyone’s experience as an intended parent or surrogate to be as joyful and as stress-free as possible. Our surrogacy professionals will go above and beyond to make sure we can help in any way possible.

Is Surrogacy Legal in Alabama?

There are no laws that either allow or prohibit different types of surrogacy in Alabama. In fact, courts in Alabama are often favorable toward the surrogacy journey if legal matters arise. Because of this, both types of surrogacy, traditional and gestational, are technically legal in the state.

Traditional Surrogacy

This type of surrogacy is when the surrogate mother has a genetic link to the child they carry. This type of surrogacy can cause potential complications due to the risk of legal issues that relate to the surrogate’s legal custody rights to the child. Elevate Baby does not offer traditional surrogacy services.

Gestational Surrogacy

Gestational surrogacy is when the surrogate, also sometimes referred to as a gestational carrier, has no genetic link to the child they will carry for intended parents. Elevate Baby only offers gestational surrogacy services.

Understanding gestational surrogacy is an important factor in helping intended parents feel knowledgeable as they take the first step towards building the family they have dreamed of. To learn more about gestational surrogacy and to match with one of our gestational carriers, contact our Alabama surrogacy professionals today.

Pre-Birth Orders

Alamaba is considered a favorable state when it comes to judgments of parentage, or the court documents that declare intended parents the legal parents of a child born via surrogacy.  Pre-birth orders are granted in many cases which greatly simplifies the legal proceedings needed to establish parentage.

Surrogates Must Meet Our Requirements to Qualify for Matching

Becoming a surrogate in Alabama is a job that comes with a lot of responsibility. These women are helping families bring life into the world as they provide the ultimate gift of hope by carrying their child. Because the job of a surrogate carries such weight, there are many requirements in place to ensure that those who take on this role are up for the job.

Surrogate mothers must meet certain requirements to be eligible to be matched with intended parents and these requirements may differ from state to state. In addition to our own agency requirements that are often more involved than those often set forth by the state, the eligibility requirements for surrogates in Alabama include the following:

  • Surrogate mothers must be between the ages of 21 and 40 years old
  • Surrogates should have a body mass index of 32 or lower
  • Surrogate mothers should already have given birth and had a healthy pregnancy
  • Surrogate mothers should already be raising at least one child
  • Surrogate mothers should be healthy
  • Surrogate mothers should be non-smokers
  • Surrogate mothers should be financially stable
  • Surrogate mothers must be willing to undergo medical and psychological evaluations

Our goal for all intended parents and surrogates is to ensure that the surrogacy journey is as stress-free as possible. When we ensure that the surrogate mothers we work with meet each of the requirements for surrogacy eligibility, this allows for the best chance of having a successful outcome. If intended parents have additional questions regarding the surrogacy journey, contact our Alabama team at Elevate Baby today.
